These Terms of Service (“Terms”) govern the services provided by Eberhart Mechanical LLC (“Company,” “we,” “our,” or “us”) to our customers (“Customer,” “you,” or “your”). By requesting, authorizing, or accepting our services, you agree to these Terms.

1. Scope of Services

Eberhart Mechanical LLC provides heating, ventilation, air conditioning (HVAC), refrigeration, mechanical, maintenance, repair, replacement, installation, and related services. Services will be performed as described in the approved estimate, proposal, work order, or service agreement.

Any additional work requested by the Customer that is outside the original scope may require a written change order and may result in additional charges.

2. Estimates and Pricing

All estimates are valid for 30 days unless otherwise stated.

Quoted prices are based on the information available at the time the estimate is prepared. Additional work required due to unforeseen conditions, code requirements, concealed defects, or customer-requested changes may result in additional charges.

Unless otherwise stated, taxes, permit fees, inspection fees, and utility company charges are not included.

3. Scheduling

Appointments are scheduled based on technician availability.

While we strive to arrive within scheduled time windows, delays may occur due to emergencies, weather, traffic, or other circumstances beyond our control.

Customers must provide safe and reasonable access to the work area.

4. Customer Responsibilities

The Customer agrees to:

  • Provide accurate information regarding the equipment and property.
  • Ensure safe and unobstructed access to work areas.
  • Keep children and pets away from active work areas.
  • Obtain any necessary permissions from landlords, homeowners’ associations, or property owners before work begins.

5. Payment Terms

Payment is due upon completion of service unless otherwise agreed in writing.

For larger projects, deposits and progress payments may be required.

Accepted payment methods may include cash, check, credit card, ACH transfer, or other approved payment methods.

Late balances may be subject to interest at the maximum rate permitted by applicable law, along with reasonable collection costs, including attorney’s fees where permitted.

Returned checks may incur a service fee.

6. Deposits and Special Orders

Deposits may be required for equipment orders, custom materials, or scheduled installations.

Special-order equipment and materials are generally non-refundable once ordered.

7. Permits and Inspections

Where required, permits may be obtained by Eberhart Mechanical LLC unless otherwise agreed.

Permit fees, inspection fees, and related costs may be billed separately unless specifically included in the proposal.

8. Warranty

We warrant our workmanship for one (1) year from the date of completion unless otherwise stated in writing.

Manufacturer warranties apply only to equipment and parts supplied by the manufacturer and are subject to the manufacturer’s terms and conditions.

This workmanship warranty does not cover:

  • Customer misuse or neglect
  • Improper operation
  • Lack of maintenance
  • Damage caused by power surges, flooding, fire, freezing, or other external events
  • Alterations or repairs performed by others

Warranty service must be requested promptly after the issue is discovered.

9. Existing Conditions

We are not responsible for pre-existing defects, hidden damage, deteriorated systems, asbestos, mold, lead paint, hazardous materials, or structural deficiencies discovered during the course of work.

If hazardous conditions are identified, work may be suspended until the issue is properly addressed.

10. Limitation of Liability

To the fullest extent permitted by law, Eberhart Mechanical LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, business interruption, or property damage resulting from equipment failure or service delays.

Our total liability shall not exceed the amount paid by the Customer for the specific services giving rise to the claim.

Nothing in these Terms limits liability where such limitation is prohibited by law.

11. Emergency Services

Emergency service availability is not guaranteed.

Emergency rates, overtime charges, holiday rates, or after-hours service fees may apply.

12. Cancellations

Appointments canceled with less than 24 hours’ notice may be subject to a cancellation fee.

If technicians arrive and cannot perform work due to lack of access or customer absence, a trip charge may apply.

13. Right to Refuse Service

We reserve the right to refuse or discontinue service if:

  • Working conditions are unsafe.
  • The Customer engages in abusive or threatening behavior.
  • Payment obligations have not been met.
  • The requested work violates applicable laws or building codes.

14. Property Protection

We will make reasonable efforts to protect the Customer’s property during service.

The Customer acknowledges that normal installation and repair work may require drilling, cutting, lifting, moving equipment, or temporary interruption of utilities.

15. Photographs

We may take photographs of equipment, installations, or work areas for documentation, warranty, training, insurance, or quality-control purposes. We will not publicly identify your property without your permission unless required by law.

16. Force Majeure

We are not responsible for delays or failure to perform caused by events beyond our reasonable control, including severe weather, supply shortages, labor disruptions, natural disasters, governmental actions, utility outages, or transportation interruptions.

17. Governing Law

These Terms shall be governed by the laws of the state in which Eberhart Mechanical LLC primarily conducts business, without regard to conflict-of-law principles.

18. Dispute Resolution

The parties agree to first attempt to resolve disputes through good-faith negotiation.

If a dispute cannot be resolved informally, either party may pursue remedies available under applicable law in a court of competent jurisdiction unless otherwise agreed in writing.

19. Severability

If any provision of these Terms is determined to be unenforceable, the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with any signed estimate, proposal, invoice, service agreement, or change order, constitute the entire agreement between the parties regarding the services provided.
